  27. <meta content="This thesis examines the social, political and legal basis for the establishment of a
  28. national regime for the oversight of risks posed by gene technology in Australia.
  29. It provides an overview of the public debate about gene technology and considers
  30. how that debate served to motivate and shift the focus of regulatory reform which
  31. led to the Gene Technology Act 2000 (Cth) (GTA).
  32. The debate about gene technology belies a much deeper social preoccupation with
  33. novel risk generally - something described by risk theorists as the 'risk society'.
  34. This risk society has placed pressure on legislatures to manage the perceived risks
  35. posed by novel technologies or to use novel technologies to manage man-made or
  36. natural risks. Yet the traditionally prescriptive and cumbersome process of
  37. regulatory reform is ill-suited to the pace and transient nature of scientific
  38. innovation. Consequently, legislatures have developed a new legislative form,
  39. risk governance, designed to provide a more flexible scientifically based
  40. response to novel technologies. This form of legislation is exemplified by the
  41. GTA. Yet risk governance has proved to create problems of its own. Maintaining
  42. regulatory flexibility necessitates that rule making is virtually, if not officially,
  43. undertaken outside of the parliamentary process. Furthermore, because risk
  44. governance adopts a scientifically based assessment and management process
  45. (risk analysis) it must co-opt technical specialists (the subjects of regulation) into
  46. the decision making process. These factors have contributed to risk governance
  47. being perceived as anti-democratic in some quarters. Such perceptions are agitated
  48. by a growing distrust of technocrat's ability to serve the public interest in the risk
  49. society. Lack of trust was a major theme throughout the Australian gene
  50. technology debate.
  51. The response to public distrust in technocratic oversight of novel technology has
  52. been the inception of risk communication, a process that encourages public
  53. involvement in risk analysis. Unfortunately, best practice risk communication has
  54. tended to be promulgated in policy but avoided in practice - something revealed
  55. with the commercialisation of gene technology. This has resulted in increased
  56. pressure to put promise into practice by institutionalising participatory risk
  57. communication principles within risk governance. I have referred to this more
  58. democratic regulatory form as 'deliberative risk governance'.
  59. The GTA was enacted with the promise that it would involve the public in all
  60. aspects of regulating risks posed by gene technology. I consider how we arrived

  226. national regime for the oversight of risks posed by gene technology in Australia.
  227. It provides an overview of the public debate about gene technology and considers
  228. how that debate served to motivate and shift the focus of regulatory reform which
  229. led to the Gene Technology Act 2000 (Cth) (GTA).
  230. The debate about gene technology belies a much deeper social preoccupation with
  231. novel risk generally - something described by risk theorists as the 'risk society'.
  232. This risk society has placed pressure on legislatures to manage the perceived risks
  233. posed by novel technologies or to use novel technologies to manage man-made or
  234. natural risks. Yet the traditionally prescriptive and cumbersome process of
  235. regulatory reform is ill-suited to the pace and transient nature of scientific
  236. innovation. Consequently, legislatures have developed a new legislative form,
  237. risk governance, designed to provide a more flexible scientifically based
  238. response to novel technologies. This form of legislation is exemplified by the
  239. GTA. Yet risk governance has proved to create problems of its own. Maintaining
  240. regulatory flexibility necessitates that rule making is virtually, if not officially,
  241. undertaken outside of the parliamentary process. Furthermore, because risk
  242. governance adopts a scientifically based assessment and management process
  243. (risk analysis) it must co-opt technical specialists (the subjects of regulation) into
  244. the decision making process. These factors have contributed to risk governance
  245. being perceived as anti-democratic in some quarters. Such perceptions are agitated
  246. by a growing distrust of technocrat's ability to serve the public interest in the risk
  247. society. Lack of trust was a major theme throughout the Australian gene
  248. technology debate.
  249. The response to public distrust in technocratic oversight of novel technology has
  250. been the inception of risk communication, a process that encourages public
  251. involvement in risk analysis. Unfortunately, best practice risk communication has
  252. tended to be promulgated in policy but avoided in practice - something revealed
  253. with the commercialisation of gene technology. This has resulted in increased
  254. pressure to put promise into practice by institutionalising participatory risk
  255. communication principles within risk governance. I have referred to this more
  256. democratic regulatory form as 'deliberative risk governance'.
  257. The GTA was enacted with the promise that it would involve the public in all
  258. aspects of regulating risks posed by gene technology. I consider how we arrived
  259. at such a system, if it matters and whether the promise of deliberative risk
